Definition, Explanation

Besides the standby duty, the on-call service is a service provided for the customers. It is essential that the employee concerned does not have to be in a certain place defined by the employer, but only have to be at disposal when called. He can thus define his whereabouts himself. He has to inform the employer about where he is. Alternatively, his availability can be ensured by a radio transmitter or mobile phone.

On-call service is to be regarded as rest time and is not counted as working time. If you are needed during this time, then it is working time. This also applies in the case of rendering a service by mobile phone or at home. The assignment is regarded as overtime and paid correspondingly. In addition, maybe night surcharges or surcharges for Sundays and public holidays are incurred. As a variable part of the salary, this type of overtime or surcharges is to be considered in the holiday allowance. Compensation through time off is not possible.

On-call service is paid for through a lump sum in addition to the income. Even the driving time from where you are to where you are going is often considered when determining the working time, depending on the distance.

Tips, Checklist

  • On-call service should be regulated in a company agreement and be the same for all employees
  • The employee organisation has the right of co determination when it comes to the introduction and structuring unless a labour agreement, the contract of employment or the company agreement regulates the on-call service
  • Make sure you really are available by phone. Not all mobile phones can be reached everywhere
  • Bear in mind that you can carry out your assignment fast enough from your whereabouts
  • There is only an obligation to on-call service if corresponding regulations are in the contract of employment or labour agreement. On-call service is principally voluntary
  • Keep to the 11-hours rest time if you are called out to an assignment
  • The risk of mistakes and accidents while working outside normal working hours increases. Ask your employer whether he has indemnity insurance that cover damage due to culpable negligence
  • If you use your own car to get there during on-call service, then the employer should accept liability for accidents
  • On-call service is not permitted during leave
